Commercial conveyancing requires a range of legal skills and experience. The usual legal issues associated with the sale and purchase of land apply, but trust law, landlord/tenant law and tax law are all relevant. Questions to be addressed often relate to GST. For example, does the margin scheme apply? Is the sale of these premises a going concern? What if the premises is occupied by a licensee and not a lessee – is that still a going concern? Whilst  I will not give you specific advice about your tax position, I will ensure that any time I act for a vendor or a purchaser in a commercial transaction their accountant  is involved and that his or her advice is incorporated into the transaction.
